The below signee hereby known as “Attendee” grants Warrior Brands DBA Victor + Valor and their affiliates (“Promoter”) it represents the right to use Attendee’s image, visual likeness, portrait, photograph, video, and sound recordings (collectively referred to as “Likeness”) in all forms of media. I confirm, acknowledge, and agree as follows:
IMAGE / LIKENESS USE
I hereby forever grant to Promoter, his/her/its legal representatives, successors, assigns, licensees, advertising agencies, and all personal or corporations acting with his/her/its] permission, the irrevocable and unrestricted right to use and re-use, publish and re-publish, and copyright my performance, likeness, portrait, photograph, sound and/or voice recording, including the negatives, transparencies, prints, film, video, tapes, digital or other information pertaining to them in all forms of media now or hereafter knows and in all manner, including electronic media, in still, single, multiple, moving or video format, in whole or part and/or composite representations, in conjunction with my own or a fictitious name, including alterations, modifications, derivations and composites thereof, throughout the world and universe for advertising, promotion, trade, or any lawful purposes.
This right shall include, but not be limited to, the right to combine my likeness with others and to alter my likeness, by digital means or otherwise, for the purposes set forth herein. I acknowledge that the depiction of me in text, photo, video or audio may be duplicated and distributed in any and all manner and media throughout the world in perpetuity. I release Promoter and any agents associated with Promoter of any claims, demands, lawsuits, that may arise in connection with the video, audio, photographs or text and their use.
I waive any right to inspect or approve the finished product, including written copy that may be created in connection therewith or the use to which it may be applied. I hereby forever release Promoter from any monetary claims and understand that I will not receive any payment for the use of these materials. I affirm that I am over the age of majority and that I am fully able to contract in my own name without breach of any prior agreement or applicable law.
In consideration of and as part for the right to participate in Promoter’s event, the undersigned, my heirs, executors, administrators, successors, and assigns do hereby RELEASE, WAIVE, ACQUIT, DISCHARGE, INDEMNIFY, DEFEND, HOLD HARMLESS AND FOREVER DISCHARGE Promoter and its owners, successors, and assigns and any of the training instructors, guides, staff or students taking part in the training in any way as well as the venue where the Events are being held any of its owners, executives, agents, or staff OF AND FROM ALL ACTIONS, CAUSES OF ACTION, CONTRACTS, CLAIMS, SUITS, COSTS, DEMANDS AND DAMAGES OF WHATEVER NATURE OR KIND IN LAW OR IN EQUITY arising from my participation in the Event.
PHYSICAL ACTIVITY
I do hereby acknowledge that the activities at the Event may pose known and unanticipated substantial risks of physical injury, psychological or mental injury and/or death, disease or illness and/or damage to, or loss of, personal property. I hereby knowingly and voluntarily assume any and all risks and do agree and acknowledge that my participation in the Events and any of the events or programs associated with the Event is of MY OWN FREE WILL AND COMPLETELY VOLUNTARY, regardless of anything stated or implied. I agree not to teach any of the activities conducted at the Event unless I am fully trained and qualified and earn my living doing so.
COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. As a result, current federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Promoter shall use best efforts to comply with all current regulations but shall not be responsible for any changes that occur.
Promoter has put in place preventative measures to reduce the spread of COVID-19. Nonetheless, Promoter cannot guarantee that myself or anyone in attendance at the photo/video shoot will not become infected with COVID-19.
I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that any person present at the photo/video shoot may be exposed to or infected by COVID-19 by attending the event and that such exposure or infection may result in personal injury, illness, permanent disability, and death.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself of the event, photo/video shoot, illness, damage, loss, claim, liability, or expense of any kind, I hereby releases, discharges, and holds harmless Promoter from any liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.
RESPONSIBILITY
I am fully responsible for any and all decisions I make in conjunction with the Event and I alone will determine which activities I will participate in. I further understand that I DO NOT HAVE TO PARTICIPATE IN ANY ACTIVITY AND I MAY WITHDRAW MYSELF FROM PARTICIPATION AT ANY TIME. I agree I will use my own free will and discretion, considering my physical and mental health, when deciding if it is appropriate for me to participate in any activity.
I also acknowledge that (1) I have read this document, (2) I will inspect the facilities, grounds, and equipment prior to being involved in any activity, (3) I will not participate until I have conducted such inspections and (4) my participation is my acceptance of the facility, grounds, and equipment, hereinafter “Sites,” as being safe and reasonably suited for the purposes intended and (5) I voluntarily sign this document.
I indicate by my signature below that I have had sufficient opportunity to read this entire release and waiver and acknowledge that I have understood it, and agree to be bound by its terms. No representation, statements, or inducements, oral or written, apart from the foregoing written statement, have been made.
